West Coast Hoppers Ltd – Terms & Conditions

1. GENERAL All sales of products described on the reverse hereof are subject to the following terms and conditions and become part of the agreement of sale. Any alterations will only be accepted in writing by West Coast Hoppers Ltd.

2. TAXES Invoiced amount for product or services is in New Zealand Dollars (NZ$) and includes GST of 12.5%.

3. TERMS OF PAYMENT
i) Standard terms are COD, Bank Cheque or Direct Credit. Buyer agrees to pay all cost of collection, including reasonable debt collection fees in the event that the seller takes action to recover payment of the unpaid amount of the invoice.
ii) A minimum deposit of 50% is required on all product sales before order will be accepted. The remaining balance must be paid upon delivery or collection of goods.
iii) A minimum deposit of 50% is required on all installation services before work will commence, the remaining balance must be paid upon date of completion. Vehicle will not be released to owner until full and final payment is received and owner will be charged for all costs associated with storing the vehicle. If payment in full is still not made 14 days from the date of completion, all products will be removed from the vehicle and the full deposit will be forfeited.

4. ERRORS Seller reserves the right to correct clerical or stenographic errors or omissions.

5. TITLE TO GOODS Passes to buyer at the time of delivery or collection. Buyer assumes all risk of damage to, loss, or destruction of said goods. No loss, injury, or destruction of said goods shall release buyer from the terms of this agreement.

6. DELIVERIES & DATES OF COMPLETION Quotations of shipping dates are based on best information available from our suppliers. West Coast Hoppers Ltd shall not be held liable for any damage, consequential or otherwise, arising from any delay or late delivery beyond our control or the control of our suppliers. Quotations of dates for supply of goods or completion of installation will be advised at the date the order is placed.

7. TERMINATION Accepted quotations and/or written orders, are not cancelable without sellers prior written permission and with the buyer will assume a termination charge amounting to 30% of the sale price.

8. SPECIAL PRODUCTS OR COMPONENTS All orders for special products and/or special components will not be considered for cancellation or return.

9. NO WARRANTIES OF ANY TYPE OR KIND All sales of products described on the reserved hereof do not come with any warranty. The warranty of merchantability and/or fitness for a particular purpose are specifically excluded. The purchaser assumes all risks of use, if any there is. Further, the sales price represents the maximum liability in connection with the sale or use, including but not limited to, any loss, damage of any kind, nature or type, delay, personal injury, misdelivery, nondelivery, or any and all other losses of any type or nature to person or property. ALL AIR RIDE KIT OR COMPONENT SALES ARE FINAL.

10. RESPONSIBILITY The purchaser and users, alone, shall determine the suitability and fitness of the product or system for his intended use and assumes all risk and liability in connection therewith. The foregoing may not be altered except by written agreement signed by a duly authorized officer of West Coast Hoppers Ltd. West Coast Hoppers Ltd shall not be liable for any consequential injuries or damages or for claims for labor loss or profit, repairs, or transportation or other expense incidental to replacement of the material and/or products sold as a component or incorporated into a system of its own design and sold as such a system for specific applications. PNEUMATIC COMPONENTS PURCHASED FOR USE IN AUTOMOTIVE AIR SUSPENSION SYSTEMS ARE DESIGNED FOR DEMONSTRATION PURPOSES ONLY! THEY SHOULD NOT BE INSTALLED ON VEHICLES WHICH ARE TO BE DRIVEN ON PUBLIC, PRIVATE OR OFF-ROAD HIGHWAYS.

11. RETURNED GOODS All materials claimed to be defective shall be held subject to inspection by the seller. Claims for shortage must be presented within five (5) days after receipt of goods or they will not be allowed. No returns for credit will be allowed without sellers prior permission. Credit will be subject to a 30% deduction for handling, inspection and expense incurred in restoring goods to saleable condition. Your original shipping and handling charges will not be refunded. All returns must be shipped freight prepaid. We will only accept a return if it is returned in the original manufacturers packaging. NO RETURNS WILL BE ALLOWED AFTER 30 DAYS FROM THE SHIPPING DATE.

12. PRICES All prices include freight, clearances and GST required in importing product into New Zealand. Freight charges are based on sea freight costs, any special orders required to be sent via Air will incur further costs. All prices are subject to change without notice.

13. ADVERTISING RELEASE West Coast Hoppers Ltd reserve the right to use photography, video or film without names or credits as they may in their absolute discretion think fit.
